Marmaduke Estates moves forward

A multimillion-dollar upscale housing development in northwest Nevada is prepared to move forward after developers have corrected an oversight on the plat application.
At Tuesday night's Nevada Planning Commission, the matter was postponed because the project developers -- Terry Hoeper and Roger Irvin -- failed to sign the plat as a corporation. They had signed it individually, but a corporate signature is also required.
That has since been rectified and Hoeper said the commission has said it would hold a special session to get the ball rolling on the first 10-acre phase of a total 440-acre development of upscale single- and multi-family homes on Willow Circle on property that formerly housed the Nevada State Hospital.
But, while it was reported that the developers did not have a clear title to the property, Hoeper said that is absolutely false.
"We absolutely have a clear title to the property," Hoeper said. "They postponed the meeting because of a plat issue, not because of a title. We've had the title since before Christmas 2003."
Amy Henry at Bowman's Vernon County Title confirmed the developers do have a clear title and that the ownership is fine.
Having a clear title is important, Henry said, "because what it really means it that you have a marketable title and that means things recorded on the land are acceptable to the person buying it."
Some acceptable conditions might be a water line easement, electric easement or telephone easement.
"You know that the electric company can come in and repair it, and that may affect your yard for a little bit, but that's OK because you need that service," Henry said.
Getting the plat approved will allow Hoeper to move forward with getting sewer permits, to match water permits they already have.
"There's a lot of positive growth in Nevada right now," Hoeper said. "We want to be participants in that."
The houses in the first phase of development -- all single-family homes -- will sell for $160,000 to $200,000.
