Judge hears motions filed in Sunshine Law suit

A motion for summary judgment has been filed in the case brought by Joe Kraft against Craig Hubler alleging that Hubler violated Missouri's Sunshine Law.

Hubler's lawyer, Robert Jester, Kansas City, argued that the facts of the case are the same as a case H & M Demolition brought against the city, which the city won.

Jester argued that since the facts were the same, that there was no intentional or purposeful withholding of records, the disposition should be the same.

He also pointed out that the original request was to the city clerk, not to Hubler.

Judge George Crocker Baldridge, Joplin, said that he wouldn't issue a ruling before the Fourth of July holiday.
