Council sets property tax, library tax levy

The Nevada City Council held a public hearing and voted 5-0 during a special council meeting Monday night pass on first reading a special ordinance increasing the city's 2010 property tax levy to 67.78 cents per $100 assessed valuation from the current 67.36 cents. The library tax will remain at 20 cents per $100 assessed valuation. Both tax rates are the maximum rates set by the Missouri State Auditors office.

The council will need to schedule another special meeting later in August so the ordinance can be finalized and the tax rate can take effect.

In other business the council:

* Approved the appointment of Bill Denman to a five-year term on the board of adjustment. His term will expire in August 2015.

* Approved the re-appointment of Ben Mendenhall to a three-year term on the street and infrastructure board. His appointment will expire in September 2013.

* Approved the appointment of Barbara Labitska to her first three-year term to the library board. Her term will expire in August 2013.

* Was presented with a clean annual audit report from DSWA Audit Firm.

* Voted 5-0 to not change the city statues to allow Lee and Kathleen Day, Cherry Street Grill owners, to obtain a liquor license to sell beer and wine at a lower fee than the current $1,050 per year required for a resort license. A city ordinance currently prohibits the sale of liquor-by-the drink on, or within one block of the Nevada Square, unless the establishment has state resort license, for which the Cherry Street Inn qualifies but has not obtained. Day told the council that he only sells about $2,000 per year of beer and wine and has trouble justifying the $1,050 license for that amount of sales.

* Voted 5-0 to pass on first reading a special ordinance adopting a set of development guidelines and creating a three step application for anyone seeking financial assistance for development or tax incentives from the city.

* Voted 5-0 to pass on first reading a special ordinance approving a contract with the Missouri Division of Family Services for a $23,003 emergency shelter grant for the Moss House. The grant will be for the period from April 1, 2010, through March 31, 2011.

* Voted 5-0 to pass on first reading a special ordinance approving a contract with the Council on Families in Crises for an emergency shelter grant of $22,553, for the period of April 1, 2010, through March 31, 2011.

* Voted 5-0 to pass on first reading a special ordinance approving an agreement with Vernon County and the Vernon County Assessor for assessment of real and personal properties within Nevada. The cost of the service will be $200 per month for the period from September 2010 through Aug. 31, 2011.

* Voted 5-0 to adopt Resolution No. 1299, the Nevada Revitalization Award to recognize improvements made by Nevada property owners.

* Voted 5-0 to adopt Resolution No. 1300 to approve a package liquor license for Tim's Convenience Store, 320 N. Osage.

* Voted 4-0, with Sherry Steward abstaining, to adopt Resolution No. 1301 approving an estimated $3,000 in travel expenses for city manager JD Kehrman, council member Sherry Steward and city clerk Annette Crews to attend the annual Missouri Municipal League annual convention Sept. 12-15 in St. Charles.

* Voted 5-0 to pass on second reading a general ordinance adopting and re-enacting the city's financial disclosure ordinance. This is required by state law for all municipalities with an operating budget more than $1 million.

* Voted 5-0 to give final approval to a special ordinance accepting a $9,016.61 settlement payment from T-Mobile for business taxes as the result of a class action lawsuit.
